Establishing Legal Fatherhood for Ogden-Area Families

When a child is born to married parents, both parents automatically share legal rights and responsibilities. That’s not the case for unmarried parents. Until paternity is legally established, a biological father has no enforceable right to custody or parent-time, and the child lacks a formal legal relationship with the father that courts can act on. For mothers, support obligations can’t be enforced without that legal foundation either.

Three Ways to Establish Paternity in Utah

Utah law provides three paths for establishing paternity. Unmarried parents who agree on the child’s biological father can sign a Voluntary Declaration of Paternity, a legally binding form that both parents sign in the presence of two witnesses. It can be completed at the hospital after birth or any time afterward. When there is a dispute, or when one party doesn’t cooperate, a court parentage action may be necessary. The Office of Recovery Services also administers an administrative process, though its authority is more limited than what a court can resolve.

Genetic testing is available through any of these routes. A DNA test can be requested voluntarily or ordered by a court to determine biological fatherhood when it is in question.

Presumed Father Status Under Utah Law

Not every paternity question involves an unmarried couple. Under Utah Code 81-5-204, a man is presumed to be a child’s legal father when he and the mother are married at the time of the child’s birth. That presumption also applies when the child is born within 300 days after the marriage ends by death, annulment, declaration of invalidity, or divorce. Where the presumed father is not the biological father, the presumption can be challenged through genetic testing and court proceedings under Utah’s parentage statute.

Why Timing Is Critical for an Unmarried Biological Father

An unmarried biological father who wants to protect his parental rights can’t wait. To establish those rights, he must file a parentage action in a Utah district court, file a Notice of Commencement of Paternity Proceeding with the Utah State Office of Vital Records, and submit an affidavit addressing custody, support, and pregnancy-related expenses.

Under Utah Code 81-13-207, an unmarried father who fails to take these steps can be permanently barred from asserting parental rights, including the right to notice if an adoption proceeding is initiated. These requirements apply regardless of whether the father was aware of them. Early action can help preserve those rights.

For parents who need more than a legal name on a birth certificate, a court action is typically the more complete option.

How Genetic Testing Works in a Contested Case

When paternity is disputed, courts rely on DNA evidence. The process involves swabbing the inside of the cheeks of the child, the mother, and the alleged father. Those samples go to a laboratory, which analyzes them to determine the statistical likelihood of a biological relationship. If the court determines that the man is the biological father based on those results, it issues a paternity order, and the father’s name is added to the child’s birth certificate. The test itself is straightforward; navigating what happens in court before and after is where legal guidance matters.
